For any aspect or clarification relating to the content of the general conditions of sale, of the contract (as defined in Section 1 below) and its regulations, Colombo Distribuzione srl is available, even by telephone, to offer the customer any clarification or information. If the customer decides not to use the telephone service, all rights and faculties recognized to the customer by law remain in any case without prejudice. In compliance with the provisions of current legislation, the general contract conditions are specified below.
1. Scope of application.
Definitions
1.1 These general conditions of sale apply to all orders sent by customers to Colombo Distribuzione srl regardless of the territory of origin, through the website www.colombodistribuzionesrl.it and regulate and constitute an integral and substantial part of all contracts stipulated by the customer with Colombo Distribuzione srl. By placing an order, the customer declares to have read and accepted these general conditions of sale. These general conditions of sale will prevail over any other general contract conditions whose application is invoked in relation to one or more contracts.
1.2. Professional (seller) means Colombo Distribuzione srl, the contracting party that sells goods and services to consumers or professionals;
Consumer means any natural person who places an order for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out;
Company/VAT number means any natural or legal person who places an order in the exercise of their entrepreneurial, commercial, artisanal or professional activity, or indicates their VAT number in the purchase order to Colombo Distribuzione srl;
Good: products sold by the Professional;
Customer must mean, depending on the case, the consumer or the entrepreneur;
Sales contract: any contract under which the trader transfers or undertakes to transfer ownership of goods to the consumer and the consumer pays or undertakes to pay the price;
Distance contract: any contract concluded between the Professional (Colombo Distribuzione srl) and the Consumer in the framework of an organized remote sales or service provision regime without the physical and simultaneous presence of the Professional and the Consumer, through the exclusive use of one or more means of distance communication until the conclusion of the contract, including the conclusion of the contract itself;
Durable medium: any tool that allows the Consumer or Professional to store the information that is personally addressed to them so that they can access it in the future for a period of time adequate for the purposes for which they are intended and which allows the identical reproduction of the stored information;
Working day means any day of the week, with the exception of Saturdays, Sundays and public holidays in accordance with the law;
Order: order means the irrevocable contractual proposal pursuant to and for the purposes of the articles. 1326 and 1329 of the Italian Civil Code, concerning the items contained in the customer's cart.
1.3. The contracts are stipulated exclusively in Italian.
2. Registration
Users who intend to use the services on the site can proceed with registration. The user who registers guarantees that he/she has read the privacy information and that the personal data provided is truthful, correct and updated, assuming all responsibility for the information provided. If there are any changes in this regard, the user undertakes to inform the company of the updates as quickly as possible.
The user is solely responsible for the custody and use of the password issued at the time of registration. The user will be liable for any illicit or incorrect use of the site through the use of the identifying password even if not intended by him or attributable to third parties.
3. Acceptance of the general conditions of sale
The contract stipulated between Colombo Distribuzione srl and the Customer must be considered concluded when Colombo Distribuzione srl receives the customer's acceptance of the sales proposal. Said acceptance, to be effective, must be completed by the payment of the entire supply or, where permitted, by the payment of the deposit for the amount foreseen for each product, with the professional's right, pursuant to art. 54 of the Consumer Code, due to even temporary unavailability of the goods or service requested, to dissolve the contract without any penalty, reimbursing the customer the sums paid by them.
By placing a purchase order, in the manner provided in the proposals, the Customer declares to have read the conditions of sale, accepting them and recognizing them as valid and effective between the parties. It also recognizes the purchase procedure as legitimate, which it accepts in full, together with the general conditions of sale and payment.
If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed with the payment of the amounts or, where permitted, the deposit on the purchase , will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of the art. 53 Consumer Code.
The formulation of the order, even if accompanied by the payment of the entire sales amount, is not suitable to determine any expectations on the part of the user as Colombo Distribuzione srl may, due to even temporary unavailability of the requested good or service, proceed to cancel the order , refunding all amounts to the customer, whether professional or consumer. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by the cancellation, even partial, of an order.
4. Purchase methods
The Customer can only purchase the products present in the electronic catalog of Colombo Distribuzione srl at the time of placing the order and which can be viewed online at www.ferramentapro.it, as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size and accessory products present in the figure. All purchase support information (Glossary, Purchasing Guide, etc...) is to be understood as simple generic information material, not referable to the real characteristics of a single product. The Company may not execute any orders received in the event that material errors occur in the insertion of product data, provided that they are recognizable (pursuant to art. 1431 cc) and not attributable to the activity of Colombo Distribuzione srl (for example generated by technical faults or line failures) committing to provide the Consumer, in the shortest possible time, with the correct information for the appropriate assessments.
Correct receipt of the order is confirmed by Colombo Distribuzione srl by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the Date and Time of execution of the order and a Customer Order Number, to be used in any further communication with Colombo Distribuzione srl. The message presents all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the methods described above.
Colombo Distribuzione srl processes purchase orders for the products offered for sale within the limits of the quantities existing in stock. Therefore, the execution of the purchase order is subject to the availability of the products in stock. In any case, the Company undertakes to promptly notify the Customer of any unforeseeable stock shortages due to excess demand or other causes, allowing the customer to credit any amount already paid to another order, or to obtain a refund. . The procedure for checking warehouse availability, also involving third parties (e.g. suppliers, transporters, etc.) can negatively impact the processing times of purchase orders which may be deferred from a minimum of one day to a maximum of 15 days ., during which the selling company will inform the customer about the evolution of the procedure.
Purchase orders are processed within the indicative terms reported in the sales proposals and, in any case, within the legal terms, always without prejudice to the possibility of releasing the parties from their respective obligations due to even temporary unavailability of the requested good or service. Failure to execute the purchase order within the legal deadlines will exclusively give the customer the right to cancel the order and receive a refund of all sums paid for the purchase.
